Fort Pierce Man Wrongfully Arrested On Gun Charge

The Florida Supreme Court met on Wednesday, November 25, 2015 to discuss whether people with a concealed carry permit should be allowed to carry a gun in public. Dale Norman, who is a Fort Pierce resident, was arrested in 2012 for carrying a gun on his hip in public. A jury convicted Norman in July 2015. The decision was upheld by the Florida 4th Circuit Court Of Appeal.

Eric Friday is a Florida open carry attorney. He stated that Norman was within his Second Amendment rights. The brief also cited federal and state case laws that prove that the United States Constitution gives people the right to openly carry a gun.

The high court accepted Norman’s case in October 2015. The brief cited cases in Tennessee and Georgia where the open carry law was found to be unconstitutional. It goes on to say that the laws regarding concealed carry are unconstitutional. It also stated the right to carry a gun is the same right that protects pornography distribution.

The brief stated that Norman’s prosecution and arrest were unconstitutional. Friday said that the way firearm law is currently being interpreted is both suspect and dangerous. Additionally, Friday stated that Bruce Colton, who is the 19th Judicial Circuit Attorney, will likely spend a month creating a response.
