DOMESTIC SQUABBLE LEADS TO FELONY ARREST—–CHARGE DISMISSED AND INNOCENT CITIZEN’S RECORD EXPUNGED
A domestic argument resulted in M.L.’s wife contacting police in case number 2006-1931-CF. The wife told law enforcement that her husband was fraudulently obtaining controlled substances from different physicians without advising the doctors of treatment by the other doctors. This behavior is sometimes referred to as “Dr. Shopping”, and constitutes a 3rd Degree felony in Florida, punishable by up to five (5) years in Prison, five (5) years probation, and a five thousand dollar ($5,000.00) fine. An arrest warrant was issued on May 2, and M.L. was arrested on May 12, 2006.
M.L. however, was an innocent man; wrongfully accused. He hired Kirschner & Garland, P.A., to protect his liberty, good name and reputation.
Board Certified Criminal Trial Lawyer Jay Kirschner moved quickly, gathering medical documentation from M.L.’s treating physicians, through which he was able to convince the State of Florida that the various medications obtained by M.L. were all garnered legally. The case was dismissed on June 15, 2006.
On July 7, 2007, the law firm obtained an Order to Expunge the client’s records, which requires law enforcement agencies to literally destroy the records of the criminal arrest and ultimate dismissal, and to permit M.L. to maintain his good name and reputation.
