Teen Arrested after Marijuana Deal Leads to Robbery

Fort Pierce Armed Robbery Attorney Jonathan Jay Kirschner

A recent illegal drug sale in Florida led to gunfire and resulted in serious firearm charges against a young teenager. According to police, a young man was at an apartment complex in his car. By his own admission, he was there to sell marijuana. A 14-year-old and a companion were also in the area of the complex. The seller met the other two young men. They sat in the seller’s car to make the transaction.

At some point during the sale, the customer and his companion allegedly attacked the seller. According to police, the 14-year-old also pulled a revolver and fired it. No one was struck by gunfire, but the 14-year-old was arrested for robbery with a firearm and discharging a firearm in public.

Jonathan Jay Kirschner, a Fort Pierce criminal defense lawyer with extensive experience as a Fort Pierce armed robbery attorney, sees glaring legal questions in this matter. For instance, how much liability belongs to the alleged victim in this case? As he himself admitted, he was in the area to engage in drug trafficking, a felony crime. Since he was in the apartment complex to sell drugs, it can also be argued that he initiated the contact with the other two young men and invited them into his car for this purpose. In short, he himself set in motion the chain of events that led to this incident.

Police also state the young suspect waived his Miranda rights and agreed to talk with police. He also admitted during the interview that he had produced the firearm. As a Fort Pierce criminal defense lawyer, Mr. Kirschner also points out these issues: As a minor, did this young man understand the rights he was waiving? Was a parent or guardian present during the interview with police, or even notified beforehand that the interview would take place? Where was the interview conducted? Was the interview recorded electronically?
