Port Saint Lucie Man Charged with DUI While Driving Lawn Mower

A 56-year-old man was arrested and charged with driving under the influence of alcohol when he was found to have been driving a riding lawn mower on an access road with a case of unopened Budweiser beer in his possession. A strong odor of an alcoholic beverage was detected after a Port Saint Lucie police officer stopped the man. Breath testing revealed that the man’s blood alcohol content was more than three times the .08 legal limit. He had apparently used the mower to make a beer run.

Is a riding mower a motor vehicle?

According to Port Saint Lucie criminal attorney Jonathan Jay Kirschner, a riding lawn mower can be interpreted to be a motor vehicle under Florida law, merely because it can transport a person. A judge will have to make that determination.
